Fayetteville man charged with murdering his infant son

Justin MarshallA Fayetteville man has been charged with murder for alleged physical abuse that led to the death of his 10-week old son.

Justin Carl Marshall, 27, was arrested Thursday following the death of his son, Justin C. Marshall II, on Wednesday.

According to Sheriff Barry Babb, deputies responded in the afternoon on Wednesday to a report of a baby that was not breathing.
They transported 10-week old Justin to Piedmont Fayette Hospital where he was pronounced dead.

According to Babb, the “baby showed signs of injuries consistent with physical abuse.”

Marshall was originally arrested on the scene Wednesday when deputies found that he was wanted for probation violation. He was also charged with misdemeanor possession of marijuana.

The child’s mother, Tabitha Marshall, was also arrested on the scene for possession of marijuana.

Continued investigation and a preliminary autopsy report points to “non-accidental trauma that was determined to have occurred during the time frame while the infant was alone in his father’s care,” according to Babb.
